This Privacy Notice describes how Amp Fit Inc. (“we”, “us”, “our”) collects, uses and discloses information about you when you use our website (https://ampfit.com/), our fitness device (“Device”), our mobile applications, services, tools and features, or otherwise interact with us (collectively, the “Services”). For the purposes of this Privacy Notice, “you” and “your” mean you as the user of the Services. Please note that the Services are designed for users in the United States only and are not intended for users located outside the United States.

Please read this Privacy Notice carefully. By using any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Notice. If you do not agree to this Privacy Notice, please do not use or access the Services.

1. CHANGES TO THIS PRIVACY NOTICE

We may modify this Privacy Notice from time to time, in which case we will update the “Last Updated” date at the top of this Privacy Notice. If we make material changes to how we use or disclose information we collect, we will use reasonable efforts to notify you (such as by emailing you at the last email address you provided us, by posting notice of such changes on the Services, or by other means consistent with applicable law) and will take additional steps as required by applicable law. If you do not agree to any updates to this Privacy Notice, please do not continue using or accessing the Services.

2. COLLECTION AND USE OF INFORMATION

When you use or access the Services, we collect certain categories of information about you from a variety of sources.

 

Information You Provide to Us

Some features of the Services may require you to directly provide certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing these features. Information that you directly submit through our Services includes:

• Contact information: Name, email address, shipping address, zip code, and phone number. We collect this information to create and maintain your account, provide you with our Device(s), communicate with you about our Services (including to tell you about products that may be of interest to you), respond to your queries, and administer surveys.
• Fitness information: Height, weight, age, gender (optional), workout history, and fitness goal. Our platform uses machine learning and artificial intelligence to enable fitness personalization and personalized workouts. To enable these features, with your consent our Services can integrate with other health applications (such as Apple HealthKit) and your personal wearable devices as identified by you, and will only process the health data and information you choose to share. We collect this information to provide you with Services, facilitate your engagement with the Services, personalize your experience, monitor and analyze trends, and conduct internal research and development.
• Account information: Username, password and security questions. We collect this information to create, maintain and secure your account. If you choose to register, you are responsible for keeping your credentials safe. Do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.
• Device information: Information about your use of the Device, including weight used, number of repetitions performed, calories burned, heart rate, active minutes, and other metrics depending on which Device you use. When your Device syncs with our applications or software, data recorded on your Device is transferred to our servers. We may also collect information about your Device’s connection to the Internet (IP address, device type, operating system, web browser) and device customization settings. We use this information to provide you with Services, monitor and analyze trends, personalize your experience, and conduct internal research and development.
• Payment information: Such as bank account, credit or debit card information, and billing address, which we collect using a third‑party payment processor. We use this information to process your payment and provide the Services as required to perform our contract with you.
• Usage information: When you access or use our Services, we receive certain usage or network activity information, including information about your Device connection to the Internet, technical information about devices you connect to the Services or pair with your account (device type, operating system, browser type, IP address), and date and time stamps each time you access the Services. We collect this information to provide you with Services, monitor and analyze trends, and conduct internal research and development.
• User‑generated content: Reviews, photos, recordings, or other content you submit through our Services or our accounts on social media platforms (“UGC”). We or others may store, display, reproduce or publish UGC. Others may have access to UGC and may share it with third parties. If you submit UGC in a public area of the Services, it will be considered public and accessible by anyone, including us.
• Any other information you choose to provide: This includes information you include in communications with us through the Services, for example when sending us an email. We use this information to facilitate your engagement with the Services, including to communicate with you about our Services (including other services that may interest you), personalize your experience, monitor and analyze trends, and conduct internal research and development.

Information Collected Automatically

We may also use cookies or other tracking technologies to automatically collect certain information about your interactions with the Services. We collect and use this information to tailor your experience with the Services, provide you with offers or promotions, run analytics, and better understand user interactions with the Services. Such information includes:

• Device information: device type, operating system, unique device identifier, and Internet Protocol (IP) address.
• Location information: precise geolocation.
• Other information regarding your interaction with the Services: browser type, log data, date and time stamps, clickstream data, interactions with marketing emails, and ad impressions.

Most browsers accept cookies automatically, but you may be able to control how your devices permit the use of cookies. If you choose, you may block or delete certain cookies from your browser; however, blocking or deleting cookies may cause some of the Services, including any portal features and general functionality, to work incorrectly. Your browser settings may also allow you to transmit a “Do Not Track” signal when you visit various websites. Information Collected From Other Sources

We may obtain information about you from outside sources, including information we collect directly from third parties and information from third parties that you choose to share with us. Such information includes:

• Analytics data: data we receive from analytics providers, which we use to improve our website, communications, and the Services.
• Other health applications and devices: that you link to your account or authorize within the Device (e.g., Apple HealthKit and other health applications) (“Third‑Party Health Products”). You control this data and can stop sharing it by removing our access to these integrations. We will only process this data if you authorize the import.
• Information we receive when you choose to link any social media platforms to your account: such as Facebook or Twitter, which we use to maintain your account and login information.

Any information we receive from outside sources will be treated in accordance with this Privacy Notice. We are not responsible for the accuracy of information provided to us by third parties and are not responsible for any third party’s policies or practices. In addition to the specific uses described above, we may use any of the above information to provide you with the Services, to customize the Services, and to maintain our business relationship, including by enhancing the safety and security of our Services (e.g., troubleshooting, data analysis, testing, system maintenance, and reporting), providing customer support, sending service and other non‑marketing communications, monitoring and analyzing trends, conducting internal research and development, complying with applicable legal obligations, enforcing our terms of service and warranty policy, and protecting the Services, our rights, and the rights of our employees, users or other individuals.

Finally, we may de‑identify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you (or we may collect information that has already been de‑identified/anonymized), and we may use such de‑identified/anonymized information for any purpose.

We may disclose your information for legitimate purposes subject to this Privacy Notice, including the following categories of third parties:

• With Third‑Party Health Products, when you link such applications and devices to your account or authorize within the Device to share your information with such companies, or otherwise direct us to share your information with third‑party sites or platforms. Use of your information by those defined terms is subject to the third party’s privacy policies.
• Vendors or other service providers who help us provide or improve the Services, including system administration, cloud storage, security, customer relationship management, marketing communications, analytics and data visualization, payment networks, and payment processing. We will not share your opt‑in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your information, including your SMS opt‑in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
• Third parties to whom you request or direct us to disclose information, such as through your use of social media widgets or login integration.
• Professional advisors, such as auditors, law firms, or accounting firms.
• Third parties in connection with or anticipation of an asset sale, merger, bankruptcy, or other business transaction.
• Our affiliates or others within our corporate group.

We may also disclose your information as needed to comply with applicable law or any obligations thereunder or to cooperate with law enforcement, judicial orders, and regulatory inquiries, to enforce any applicable terms of service, warranty policy, and to ensure the safety and security of our business, employees, and users.

4. SOCIAL FEATURES

Certain features of the Services allow you to initiate interactions between the Services and third‑party services or platforms, such as social networks (“Social Features”). Social Features include features that allow you to access our pages on third‑party platforms, and from there “like” or “share” our content. Use of Social Features may allow a third party to collect and/or use your information. If you use Social Features, information you post or make accessible may be publicly displayed by the third‑party service. Both we and the third party may have access to information about you and your use of both the Services and the third‑party service. 5. THIRD PARTY WEBSITES AND LINKS

We may provide links to third‑party websites or platforms. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies, and other terms. We are not responsible for the privacy or security of, or information found on, these sites or platforms. Information you provide on public or semi‑public venues, such as third‑party social networking platforms, may also be viewable by other users of the Services and/or users of those third‑party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

6. ACCESS/ACCURACY

To the extent that you do provide us with information, we wish to maintain accurate information. If you would like to delete or correct any of your information that we may be storing, you may submit an access request by sending an email to us at privacy@ampfit.com. Your request should include adequate details of your request. We may need to verify your identity before processing certain requests.

7. MERGER, SALE OR BANKRUPTCY

In the event that we are acquired by or merged with a third‑party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer or assign information in connection with the foregoing events.

8. CHILDREN’S PRIVACY

If you are between 15 and 18, you may use our Device and Services only with the permission and under the direct supervision of a parent or guardian through a minor account created by your parent or guardian. If you are a minor using a minor account, your parent or guardian will have the ability to view your activity on the minor account and change your settings. You may request deletion of information associated with your minor account by sending an email to us at privacy@ampfit.com. If you are the parent or guardian of a child under 13 years of age who has provided us with personal information, please contact us using the information below to request that it be deleted. We do not seek or knowingly collect any personal information about children under the age of 13. If we become aware that we have unknowingly collected information about a child under 13, we will make commercially reasonable efforts to delete such information from our database.
