AMP FIT CONSUMER HEALTH DATA PRIVACY NOTICE

This Consumer Health Data Privacy Notice applies to people living in Washington and for people whose Consumer Health Data is collected in that state and supplements the amp Fit Privacy Notice (“Privacy Notice”). This Consumer Health Data Privacy Notice applies to personal data defined as “consumer health data” subject to the Washington My Health My Data Act.

What is Consumer Health Data?

“Consumer Health Data” is personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status. Consumer Health Data does not include, among other things, data that cannot reasonably be used to infer information about, or otherwise be linked to, an identifiable or identifiable individual, or a device linked to such an individual.

Our Collection of Consumer Health Data

To provide our fitness device (“Device”), our mobile applications, products, services, tools, and features (“we”, “us”, “our” and such devices, applications, products, services, tools, and features, the “Offerings”), we collect and process information about you, including information that could be considered Consumer Health Data. The information we collect depends on how you interact with us and use the Offerings, as described further in the “Collection and Use of Information” section of our Privacy Notice.

Depending on how you interact with us and our Offerings, we may collect the following information that may be considered Consumer Health Data:

  • Bodily functions, vital signs, or measurements relating to a health status
  • Information that that is derived or extrapolated from non-health information that we process to associate or identify a consumer with the data described above

Sources of Consumer Health Data

Depending on how you interact with us and the Offerings, we may collect Consumer Health Data about you directly from you (which may include your interactions with our websites and the Offerings), other health applications and devices that you link to your account or authorized within our Offerings (e.g., Apple’s HealthKit, and other health applications), and vendors and third parties, as described further in our Privacy Notice. 

Why We Collect and Use Consumer Health Data

We collect and use Consumer Health Data as reasonably necessary to provide you with the Offerings you have requested. This may include:

  • Providing, personalizing and improving the Offerings
  • Providing measurement, analytics and other business services
  • Promoting safety, integrity and security
  • Communicating with you
  • Other essential business operations that support our ability to provide you with the Offerings, such as understanding (in aggregate) usage of the Offerings and conducting research and development
  • Complying with our legal obligations

We may also collect, use and disclose Consumer Health Data for other purposes with your consent or authorization. For additional information on our use of information, please see the “Collection and Use of Information” section of our Privacy Notice.

Disclosure of Consumer Health Data

We may disclose each of the categories of Consumer Health Data described above as reasonably necessary to provide you with the Offerings you have requested (as described above), or for other purposes with your consent or authorization.

We share Consumer Health Data with the following categories of third parties:

  • Third-Party Health Products, when you link such applications and devices to your account or authorize within the Device to share your information with such companies, or otherwise direct us to share your information with third-party sites or platforms, and use of your information by those defined term is subject to the third party’s privacy policies
  • Other apps, websites, and third-party integrations on or using the Offerings
  • People and accounts you share and communicate with, if such features are available
  • New owners in the event of a change of ownership or control of all or part of us or the Offerings
  • Vendors who help us provide the Offerings, including for system administration, cloud storage, security, customer relationship management, marketing communications, and web analytics
  • Our affiliates or others within our corporate group
  • Law enforcement or other third parties in connection with legal requests, to comply with applicable law or to prevent harm

We may also share Consumer Health Data with additional categories of third parties with your consent or authorization. For additional information regarding our sharing of information, including Consumer Health Data, please see the “Disclosure of Your Information” section of our Privacy Notice.

Your rights regarding Consumer Health Data

If you are a resident of Washington state, you may have certain rights in relation to your Consumer Health Data, subject to certain exceptions, including the right to:

  • Request that we confirm whether we are collecting or disclosing your Consumer Health Data (and with whom), and to access such Consumer Health Data
  • Request the deletion of your Consumer Health Data
  • Request to withdraw your consent for the collection or disclosure of your Consumer Health Data
  • Review and request changes to your Consumer Health Data

 

You may exercise any of these rights, and as applicable, to appeal a consumer rights action, by contacting us using the information provided below.  We may need to collect information from you to verify your identity, such as your email address or date of birth before providing a substantive response to the request.

Changes

We’ll notify you before we make material changes to this Consumer Health Data Privacy Notice. You’ll have the opportunity to review the revised Consumer Health Data Privacy Notice before you choose to continue using our Offerings.
